1. General
These terms of sale apply to purchases and orders made through theclash.ee. The seller is MTÜ The Clash Baltic (registry code 80635294, located in Pärnu, Estonia; e-mail info@theclash.ee), hereinafter the “Seller”. The “Buyer” is a natural or legal person who places an order or buys an event ticket via theclash.ee.
By completing a purchase the Buyer confirms that they have read and accepted these terms. The Seller may amend these terms; the terms in force at the time the order is placed apply to that order.
2. Event tickets
Tickets to The Clash events (including The Clash 5) are sold through Piletitasku. The ticket sales contract is concluded between the Buyer and Piletitasku / the event organiser, and Piletitasku’s terms of sale apply to it. theclash.ee directs the Buyer to Piletitasku to purchase a ticket.
Before redirecting to Piletitasku, theclash.ee may ask for the Buyer’s e-mail address (to join the newsletter and receive a discount code). Sharing your e-mail is voluntary and handled in accordance with the privacy policy.
Entry to an event is subject to the organiser’s rules, including age limits and safety requirements. A ticket grants admission to the event according to its ticket type.
3. Ticket refunds and event changes
Under § 53 (4) 7 of the Estonian Law of Obligations Act, the 14-day right of withdrawal does not apply to event tickets, as they concern a leisure service provided on a specific date. Purchased tickets are generally not refunded or exchanged.
If an event is cancelled or postponed, the organiser will notify the Buyer, and refunds or ticket validity follow the organiser’s and Piletitasku’s refund policy. The Seller is not liable for consequences arising from incorrect data entered by the Buyer.
4. Sale of goods (online shop)
Once the theclash.ee online shop is open, the following terms apply to the sale of goods (e.g. fan merchandise). Prices are in euros and include VAT. The Seller may change prices and the product range.
- Payment: orders are paid via the Montonio payment solution (bank link or card payment).
- Delivery: goods are sent to a DPD or Omniva parcel machine. Delivery is free on orders of €200 or more.
- Delivery time: goods are generally dispatched within 3–7 business days after payment is received; the exact time is stated in the order confirmation.
5. Right of withdrawal (goods)
A Buyer who is a consumer has the right to withdraw from goods bought in the online shop within 14 days of receiving them, without giving a reason. The right of withdrawal does not apply to event tickets (see section 3) or to goods made to the Buyer’s personal specifications.
To withdraw, the Buyer notifies the Seller at info@theclash.ee and returns the goods within 14 days. Returned goods must be unused and in their original packaging. The direct cost of returning the goods is borne by the Buyer. The Seller refunds the amount paid within 14 days of receiving the returned goods.
6. Right to file a complaint
A consumer has the right to file a complaint about goods not conforming to the contract within 2 years of receiving them. The Seller is not liable for defects caused by improper use or normal wear and tear.
7. Processing of personal data
Personal data is processed in accordance with the privacy policy. Data collected during a purchase is used to fulfil the order and to communicate with the Buyer.
8. Dispute resolution
These terms and any purchase are governed by the law of the Republic of Estonia. Disputes are resolved through negotiation. If no agreement is reached, a consumer may turn to the Consumer Disputes Committee at the Consumer Protection and Technical Regulatory Authority (ttja.ee) or use the European Union online dispute resolution platform (ec.europa.eu/odr).
